Privacy Policy for the REACH Platform and Customer’s hosted applications

CosmiCube, Inc. (“CosmiCube”, “we” or “us”) provides a platform where customers (“CosmiCube Customers”) can host mobile applications developed by CosmiCube (“Applications”) as well as receive related development and support services (“Services”). This Privacy Policy is made available on our website (“Site”) at http://cosmicube.com/privacy, and provides information on our policies and procedures regarding the collection, use and disclosure of personal information we receive from (i) CosmiCube Customers, (ii) end users that download and use the Applications (“End Users”), and (iii) visitors just browsing the Site (“Visitors”).

This Privacy Policy covers CosmiCube’s treatment of personally identifiable information (“Personal Information”) that CosmiCube gathers when you are accessing our Site or using an Application. This policy does not apply to any other service provided by a CosmiCube Customer or the practices of any organizations or companies that CosmiCube does not control, or to individuals that CosmiCube does not employ or manage. In addition, the Applications may contain links to outside sources, including Facebook and Twitter. We cannot take responsibility for the content or privacy policies of those services. We encourage you to carefully review the privacy policies of any web sites or other online services you visit.

(A)       CosmiCube Customers

• If you are a CosmiCube Customer, when you register with us through the Site, we will ask you for personally identifiable information, such as your name, company name, email address, and phone number.. We use such Personal Information mainly to provide the Services, administer your inquiries, and contact CosmiCube Customers regarding account activities, new version and product offerings, or other communications relevant to the Services.
• In addition, we may collect information related to interactions of End Users with your Applications as described in part (B) below.
• We do not sell any Personal Information of CosmiCube Customers to any third parties. The instances where we may share such information with third parties are described in Section (B)(II) below.
• You may review and update the Personal Information in your registration profile by logging in and editing such information in your account profile. If you decide to delete all of your information we may cancel your account. We may retain an archived copy of your records as required by law or for legitimate business purposes.
• To the extent you are an End User of an Application or a Visitor to this Site, the terms of Section (B) will also apply to you.

(B)       End Users and Visitors

CosmiCube knows that you care about how your Personal Information is used and shared, and we take these matters very seriously. The following sections of this Privacy Policy outline how we gather your personal data, and what we do with it.

By installing and using an Application and/or by visiting this Site, you acknowledge that you accept the practices and policies outlined in this Privacy Policy as they apply to such activity.

I. WHAT PERSONAL INFORMATION DOES COSMICUBE COLLECT?

The information we gather from Application users enables us to personalize and improve our services and to allow our users to set up a user account and profile that may be used to interact with other End Users through the Application. Depending on the Application, we may request and display some personal information to other End Users of that Application and Visitors to the Site, which allows End Users to identify each other. We may collect the following types of information from End Users and Visitors:

Personal Information You Provide to Us:

We may receive and store any information you enter into an Application or provide to us in any other way. The types of Personal Information collected may include your:

• user name
• email address
• use information
• geographic location and
• account information for other social media services such as Facebook and Twitter.

If you elect to connect an Application to your accounts on other social media services like Facebook and Twitter you authorize us to share information collected by the Application with Facebook and Twitter so that it can be connected to your account on those services.  We have no control over, nor do we accept any responsibility for the manner in which this information is displayed in your account on those other social media services. For example, if an Application requests and you provide geolocation data and you link that Application to your Facebook account, we will provide that geolocation data automatically to Facebook.  If you have signed up for Facebook Places, Facebook may use the geolocation data you have authorized us to provide to show your location in your Facebook profile. The display of such information in your Facebook account is subject to the settings on your Facebook account, which you control.

Personal Information About Others:

Certain functions of Applications may ask you for personal information about others, (e.g., Emergency Contact, Physician, Child Care and Child’s School). The information displayed by Applications is pulled from the contact list on the device on which the Application is installed and is not stored by the Application, a CosmiCube Customer or CosmiCube. To use this functionality you either select a contact from your existing contact list on the device, or the Application will allow you to create a new contact in the contact list on that device. We do not collect that information.

Personal Information Collected Automatically:

We receive and store certain types of information whenever you interact with our Site. Our Site automatically receives and records information on our server logs from your browser including your IP address, and the page you requested.

Our service automatically collects usage information, such as the numbers and frequency of Visitors to our Site. CosmiCube only uses this data in aggregate form and not in a manner that would identify you personally. This type of aggregate data enables us to figure out how often customers use parts of the Site or services so that we can make the Site appealing to as many users as possible, and improve those services. As part of this use of information, we may provide aggregate information to our partners about how our users, collectively, use our Site. We share this type of statistical data so that our partners also understand how often people use their services and our Site, so that they, too, may provide you with an optimal experience. CosmiCube only discloses aggregate information to a partner.

Cookies

Cookies are pieces of data assigned by a Web server that uniquely identify the browser on your computer. Web sites typically use temporary cookies called “session” cookies to ensure that you are recognized when you move from page to page within one site and that any information you have entered is remembered. For example, if an e-commerce site did not use session cookies then items placed in a shopping basket would disappear by the time you reach the checkout. Web sites also use cookies called “persistent” cookies to enable a Web site to remember you on subsequent visits, speeding up or enhancing your experience of services or functions offered.

CosmiCube.com may set and access both persistent and session cookies on your computer. You have the option to accept or disable cookies at any time through your Web browser. Visit the “help” portion of your toolbar for more information. Your decision to accept or reject a cookie will not affect your ability to access the CosmiCube.com Site, however, the Site may not function as intended if a cookie is rejected. Our Sites’ cookies are not linked to any personally identifiable information.

Location-Based Services:

To provide location-based services, we may collect, use, and share precise location data, including the real-time geographic location of your mobile device. Certain aspects of an Application may require location data to function.

Children:

We do not knowingly collect personal information from children under 13. If we learn that we have collected the personal information of a child under 13 and such information is stored in our systems we will take steps to delete the information as soon as possible. However, we do not have the ability to deactivate an installed copy of an Application or remove data stored on a mobile device.

II. HOW IS YOUR PERSONAL INFORMATION USED?

The Personal Information you provide is used for such purposes as allowing you to interact with other users, improving the content of our service, customizing the content you see, and communicating with you about new features. We may share Personal Information you provide with third parties who are responsible for supporting or performing aspects of the Site and our services, including the Applications. Such third parties will be contractually obligated to keep your Personal Information confidential and only to use it to support the Site and our services.  We may also draw upon this Personal Information in order to adapt the Site and our services to your needs, to research the effectiveness of our network, and to develop new tools for CosmiCube Customers.

We may provide to the CosmiCube Customer associated with a given Application downloaded by an End User that End User’s email address and other Personal Information collected by that Application.  By downloading and installing an Application You consent to our sharing such Personal Information with such CosmiCube Customer and You consent to receiving communications from such CosmiCube Customer.  However, CosmiCube Customers are contractually obligated not to share with third parties for marketing purposes any of Your Personal Information that we share with them.  For the purposes of Section IV, below, You agree that CosmiCube Customers do not constitute third parties.  Certain CosmiCube Customers may request additional personal information from You as part of such communications – CosmiCube is not responsible for, and shall have no liability to You for, the use by any CosmiCube Customer of any Personal Information that You provide directly to a CosmiCube Customer.

As CosmiCube continues to develop, we might sell or buy lines of business or assets. If all or substantially all of CosmiCube’s business (or a line of business) or assets (or the assets of a line of CosmiCube’s business) are acquired by a third party, Personal Information of CosmiCube Customers, End Users and Visitors will generally be one of the transferred business assets. We reserve the right to include your collected Personal Information and other information we collect as described herein as an asset in any such transfer to a third party.

III. IS PERSONAL INFORMATION ABOUT ME SECURE?

Your Personal Information is protected by the password on your computer or mobile device. You need to prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer and mobile device software by signing off after you have finished accessing your account, and guarding your mobile device against unauthorized use.

CosmiCube endeavors to protect Customer, End User and Visitor information, however, neither CosmiCube nor any CosmiCube Customer can guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, loss of mobile device and other factors, may compromise the security of user information at any time.

Applications and this Site may contain links to other Web sites. CosmiCube is not responsible for the privacy policies and/or practices on other Web sites. When linking to another Web site you should read the privacy policy stated on that site. This Privacy Policy only governs information collected via an Application or this Site.

IV.  WHAT PERSONAL INFORMATION ABOUT ME CAN I ACCESS?

Each Application may allow you to view information collected by that Application on the mobile device on which that Application is installed. To the extent you have created an account on this Site, we will enable you to access the following information about you for the purpose of viewing, and in certain situations, updating that information. This list will change as our Services change.

• Username
• Email address
• Password
• User profile information

In accordance with California Civil Code Section 1798.83, we will not provide Your Personal Information to third parties for their marketing purposes. California residents may request further information about our compliance with this law by emailing CaliforniaPrivacy@CosmiCube.com. Please note that we are only required to respond to one request per person per year and we are not required to respond to requests made by means other than through this email address.

V.  DELETING YOUR ACCOUNT

Should you ever decide to delete your account associated with a specific Application, you may do so by disconnecting the application from any social media account to which you have linked it, and by deleting that Application from your mobile device.  Because of the way some applications function, residual copies of your profile information or posts may remain on backup media.

If you are a CosmiCube Customer and wish to delete your application administrator account, you may contact customer service at REACHsupport@CosmiCube.com.

VI. CHANGES TO THIS PRIVACY POLICY

CosmiCube reserves the right, at any time, to modify, alter, or update this Privacy Policy without prior notice. If we make a material modification to this Privacy Policy, we will notify you by (1) sending an email to the email address you have provided in your account (if any) and, (2) displaying an announcement on the CosmiCube website for thirty (30) days. After the notice of such modification has been posted for 30 days, the notice will be removed. A brief description of any material modification and the date it went into effect will be placed in the Historical Modifications section at the end of this Privacy Policy. If you have not used the CosmiCube Site or any Applications for more than 30 days, you should check the Historical Modifications section for any modifications to this Privacy Policy prior to any further use of the CosmiCube Site or Applications. Should you wish to terminate your account due to a modification to this Privacy Policy, you may do so as described in the Deleting Your Account section. If you choose to continue using any Application or this Site after such a modification, you agree that by doing so you will be deemed to accept the Privacy Policy.
